Call to Order:
Acceptance of May 14, 2003 Minutes
The minutes were unanimously accepted and
approved.
Acceptance of Agenda:
The agenda was accepted with no changes
Prior to commencement of official Board business, Pat Call, Cochise County
Supervisor addressed the group and discussed several issues as follows:
From a county perspective, there will be no change in the 3 Canyons road.
It will remain a private road.
Even if the residents and the county agreed to turn 3 Canyons roadway over
to the county, every owner would have to deed their share of the road to
the public - a virtual impossibility because everyone who purchased land
expected the road to be private. Therefore if even one owner would not deed
their share it could be upheld in court.
Overall, the county is approximately $125M short in county funds for roadway
maintenance.
ADOT plans to widen Highway 92 to 3 Canyons road. They would extensively
rework the Hereford road intersection, probably even make it a lighted intersection.
John Williams now owns the trailers at Highway 92 and Hereford road and
has made an effort to bring the units just up to legal standards. As such,
he is within the law and regulations to keep the trailers there as they are.
Pat sends out emails on an irregular basis, when he feels he has something
interesting to share with the residents. If you are interested in getting

There is also a county web site that has interesting information and links
to other sites, including Pat's email. This web site is www.cochisecounty.com.
Call to Membership:
Nothing discussed or added to the agenda.
Presidents Report:
Tom Pickering stated that there are dogs running loose in the community.
Ordinance 4.2.4 discusses this issue.
Attorney Report:
In response to our complaints, Fidelity National Title Agency has acknowledged
its failure to provide this firm with notification of transfers and promises
to comply in the future.
Cardinal & Stachel, P.C. again requested a list of the member's email
addresses. The accounting system used by the firm has a data field for email
addresses and its utilization would make the master database more complete.
The email addresses will NOT be disclosed.
Cardinal & Stachel are not receiving requests for assessment status
from the Master Design Committee when approving new construction and additions.
This would be an additional tool to find ownership's that have not been reported.
Counsel has mailed (Certified) a warning letter to a non-member identified
as using 3 Canyons Road without proper authorization.
Attached to this report are the Master Design Guidelines, including suggested
modifications. The Board of Directors must adopt the Guidelines. The approved
Guidelines must be signed by the President and recorded in the Office of
the Cochise County Recorder.
The Association is not a party (Plaintiff or Defendant) to any pending litigation.
However, San Pedro Development II and Wildhorse HOA are contemplating litigation
in an effort to extricate Wildhorse I & II from the jurisdiction of 3
Canyons Master HOA. Counsel for 3 Canyons Master HOA has met, in executive
session, with the Board of Directors to discuss the legal merits and strategy
in defending the anticipated litigation.
Counsel also advised orally that a certified letter has been sent to a 3
Canyons member demanding payment for fence destruction along Bloomfield Road.
Design Committee Report:
Approved three outbuilding permits
Approved one new barn permit
Have two house building permits pending
Governing Documents Committee:
Jim Picard stated that signed ballots for the proposed wording change to
the CCR's are coming in from the mass mailing. There has been a good response
so far. The returns have now slowed to a trickle.
Jim Picard reported that the attempt at a neighborhood meeting among Bloomfield
residents regarding fences and gates was non-productive. Jim personally condemns
any vandalism in the neighborhood. He stated that there is a faction of residents
who seem to want no solution to the gate and fence issue. The Board greatly
appreciates Jim's effort in this matter.
New Business:
Regarding the
Amendment to the Master Design Guidelines of 3 Canyons Ranch
attached to these minutes, Darryl Crowley made a motion that the Board accept
the Amendment as written. Seconded by Gary Brock. The Board approved the
motion.
Call to Membership:
Tommy Stoner asked if Wildhorse II was annexed into 3 Canyons. Tom Pickering
stated that 3 Canyons HOA considers them as part of 3 Canyons HOA.
Other:
Assessments will be mailed out within the next two weeks.
JULY 26TH IS OUR ANNUAL MEETING. IT WILL BE HELD AT PDS COUNTRY CLUB
BEGINNING AT 12:00 NOON. PLEASE PLAN TO ATTEND. This will be the
only meeting in July.
Jim Picard asked how the votes were determined. Tom Pickering reminded us
that the owners get one vote for each acre owned (rounded down) and one vote
for each 100 sq. ft. of living area (rounded down). Gene Mundt's Example:
if you own 7.34 acres and have a home with 2,730 sq. ft. of living space,
you would have 34 total votes.
A motion was made and seconded to adjourn. Time: 6:30 p.m.
